SAACPP member firms assist land owners and property development companies to apply to the responsible authority (typically a Municipality) to amend the provisions of a land use scheme by the rezoning of one or more properties to allow for the development thereof in accordance with the adopted policy of the Municipality for the area concerned.  This typically involves the co-ordination of the efforts of a team of consultants including the likes of:

    • a Land Surveyor
    • a Conveyancer
    • Civil and Electrical Consulting Engineers
    • Traffic Engineers
    • Environmental Assessment Practitioners
    • Geotechnical Consultants; and
    • Architects

  • APPLICATION TO ESTABLISH A TOWNSHIP

SAACPP member firms assist land owners and property developers to apply for authorisation to establish a township on land to make possible the development thereon envisaged for the area.  The process of township establishment is typically a multi-disciplinary affair, co-ordinated by the Professional Planner on behalf of the instructing client.

  • SUBDIVISION AND CONSOLIDATION OF LAND

SAACPP member firms represent land owners and property developers in their endeavours to consolidate and subdivide various categories of land (erven in proclaimed townships, registered farm portions and agricultural holdings) to re-arrange the boundaries of the site assembly to unlock the development potential of the land to the extent required.

  • APPLICATIONS FOR CONSENT OR DEPARTURES

SAACPP member firms represent land owners and property developers in seeking relief from the responsible authority (typically the Municipality) to procure consent to use land for a particular purpose or to depart from any relevant restriction in regard to the extent of the development of the land.  This may include the relaxation of building lines, increasing the permissible height of a building, enlarging the permissible coverage of a building complex or similar.

  • REMOVAL OF TITLE CONDITIONS

SAACPP member firms assist land owners and property developers to have restrictive conditions of title or servitudes removed from the title deeds of affected properties where such provisions militate against the intended development on the land.

  • APPEARING BEFORE MUNICIPAL PLANNING TRIBUNALS AND APPEAL AUTHORITIES

SAACPP member firms assist land owners and property developers by representing them during hearings scheduled by Municipal Planning Tribunals or Appeal Authorities in disputed land development application matters. This typically occurs where a proposed development is opposed by an interested or affected party, resulting in a hearing to resolve the matter.

  • EXPERT WITNESSES

SAACPP members with appropriate experience may be briefed to appear in a Court or Arbitration proceedings or similar and to present an Expert Opinion in regard to a Spatial Planning or Land Use Management matter where same forms the subject of a dispute.  This may include to act as Expert Witness in disputed property valuation matters, expropriation matters and related legal processes.

  • GENERAL PROPERTY DEVEOPMENT ADVISE

SACCPP members firms may assist property owners and property developers by advising on planning related considerations which inform the potential development of land. For such purpose a Due Diligence Investigation may be conducted by the Professional Planner resulting in conclusions and recommendations for consideration by the instructing client prior to final decisions being taken in regard to a property development investment.

  • CLOSURE AND ALIENATION OF PUBLIC PLACES

SAACPP member firms may assist property developers to acquire public land (typically land owned by a Municipality) for development purposes.  This may include a part of a public road reserve (public place), a public open space (or park) or similar.  This may include a process to close the public place in order to convert the affected land portion into a registrable and developable property to be acquired by the instructing client.

  • SITE DEVELOPMENT PLANNING

SAACPP member firms may assist property developers in preparing Site Development Plans as precursors to the submission of technical building plans prior to the commencement of construction on a development property.  This is typically attended to in collaboration with the appointed Architect and Consulting Engineers and includes a proper interpretation of the statutory zoning provisions and development restrictions which regulate the use of the land in question.
